a. INTRODUCTION

 

We understand that you care how information about you is used and shared and we appreciate your trust that we will do so carefully and sensibly. This Privacy Policy describes our practices in connection with privacy and the Personally Identifiable Information (as defined below) that we collect through this website, the related mobile sites and mobile application(s), and selected other domains (the “Sites”). Except as indicated below, this Privacy Policy does not address the collection, use or disclosure of information by any of our affiliates or by other third parties on any websites other than the Sites.

 

By accessing and/or using the Sites, you agree to all the terms and conditions of this Privacy Policy. We may change this Privacy Policy from time to time and without prior notice. If we make a change to this Privacy Policy, it will be effective as soon as we post it, and the most current version of this Privacy Policy will always be posted under the Privacy Policy tab of this website and on the App. If we make a material change to this Privacy Policy, we may notify you. You agree that you will check out this Privacy Policy periodically. By continuing to access and/or use the Sites after we make changes to this Privacy Policy, you agree to be bound by the revised Privacy Policy. You agree that if you do not agree to the new terms of the Privacy Policy, you will stop using the Sites.

 

b. NOTICE ABOUT THE INFORMATION WE COLLECT

 

THE DOORBELL APP collects two primary types of information:

 

Personally Identifiable Information (PII) – is information that identifies you as an individual.In order for you to take full advantage of our services (for example, to use the services offered on the app), we may require that you furnish PII. PII includes the following information:

Contact information: such as name, date of birth, address, telephone number, and e-mail address

Financial information: such as credit card number, expiration date, and billing address.

Delivery information: such as your home/work/alternate delivery location, and any delivery notes thereof.

 

Non-Personally Identifiable Information (Non-PII) – is aggregated information, demographic information and any other information that does not reveal your specific identity. We and our third party service providers may collect your Non-PII, including:

 

Information about the device you are using in using / accessing the Sites

Information from referring websites

Your interaction with the Sites

 

We and our third party service providers also may aggregate PII in a manner such that the end-product does not personally identify you or any other user of the Sites, for example, by using PII to calculate the percentage of our users who have a particular telephone area code.

Location information – depending on the THE DOORBELL APP services that you use, and your app settings or device permissions, THE DOORBELL APP may collect your precise or approximate location information as determined through data such as GPS, IP address and WiFi.

Transaction information – we collect transaction details relating to your use of our services (including the type of services you requested, date and time of the service, and amount of the service)

Usage and preference information – we collect information about how you interact with our services, preferences expressed, and settings chosen. In some cases we do this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers.

Device information – we may collect information about the devices you use to access our services, including the hardware models, operating systems and versions, software, file names and versions, preferred languages, unique identifiers, advertising identifiers, serial numbers, device motion information, and mobile network information.

Log information – when you interact with our services, we collect server logs, which may include information like device IP address, mobile ID, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service or were using before interacting with our services.

Personal and shared contact details – If you permit the THE DOORBELL APP app to access your address book on your device, we may collect the names and contact information from your address book to facilitate social interactions through our services (such as the ‘Split the Bill’ functionality)

c. NOTICE ABOUT HOW WE USE YOUR INFORMATION

THE DOORBELL APP is entitled to use or disclose your personal information if such use or disclosure is required in order to comply with any applicable law, subpoena, order of court or legal process served on us, or to protect and defend our rights as a company. In the event of a fraudulent online payment, THE DOORBELL APP is entitled to disclose the relevant personal information for criminal investigation purposes or in line with any other legal obligation for disclosure of the personal information which may be required of it.

 

With the above clause in mind, THE DOORBELL APP may make use of your personal information in the following ways:

Location information: enables transportation and delivery of your purchase

Transaction information: enables THE DOORBELL APP to process or facilitate payments for our services

THE DOORBELL APP uses the information we collect to assist you when you contact our customer support services, including to:

Direct your questions to the appropriate customer support person

Investigate and address your concerns

Monitor and improve our customer support responses

 

Research and Development

THE DOORBELL APP may use the information we collect for testing, research, analysis and product development. This allows us to improve and enhance the safety and security of our services, develop new features and products, and facilitate finance solutions in connection with our services.

 

Communication Among Users

THE DOORBELL APP uses the information we collect to enable communications between our users and our partner drivers. For example, a driver partner may text or call a client to confirm a delivery address or ask for additional directions.

 

Communications From THE DOORBELL APP and Partners

THE DOORBELL APP may use the information we collect to communication with you about products, services, promotions, surveys, news, updates and events. THE DOORBELL APP may also use the information to promote competitions, to fulfill any rewards programmes, and to serve relevant ads and content about our services and those of our business partners. Further, the THE DOORBELL APP customer service team may contact a client to confirm order details, delivery notes and, in certain situations, to send a link to a 3D secure payment portal.

d. NOTICE ABOUT HOW WE SHARE YOUR INFORMATION

THE DOORBELL APP and our third party service providers may disclose PII:

 

As required to fulfill your purchase (e.g. to our partner stores to enable them to fulfill your order). Our employees and/or third party service providers who assist us to interact with you via our platforms, email for any other method, for the ordering of goods or when delivering goods to you. The abovementioned personnel therefore need to know your personal information in order to assist THE DOORBELL APP to communicate with you properly and efficiently.

To provide services such as payment processing, website hosting, data analysis, infrastructure provision, IT services, customer service, e-mail delivery services, and other similar services, to enable them to provide services.

To third parties sponsors of Promotions (irrespective of whether such Promotions are hosted by us), or otherwise in accordance with the rules applicable to such Promotions. You should carefully review the rules, if any, of each Promotion in which you participate, as they may contain additional important information about our, a sponsor’s and/or other third parties’ use of your PII. To the extent that the rules of those Promotions concerning the treatment of your PII conflict with this Privacy Policy, the rules of those Promotions shall control.

To an affiliate or other third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including without limitation in connection with any bankruptcy and/or similar proceedings).

To law enforcement, government officials, fraud detection agencies or other third parties when we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report or support the investigation into suspected illegal activity, or to investigate violations of these terms and conditions

Ratings and reviews – when you provide a rating or review of service received, you consent to us using that rating / review as we deem fit, including without limitation on the Website, in newsletters or other marketing material. The name that will appear next to that review will be your first name, as you would have provided upon registration. We will note display your last night, nor any of your contact details, with a rating or a review.

Except as expressly set forth herein, this Privacy Policy does not address, and neither we nor our third party service providers are responsible for, the privacy, information or other practices of other websites and/or any third parties, including without limitation any of our affiliates and/or any third party operating any site to which the Sites contains a link. The inclusion of a link to a third party website on the Sites does not imply endorsement of the linked site by us or by our affiliates. Please note that your access and/or use of any third party websites, including by providing any information, materials and/or other content to such sites, is entirely at your own risk. THE DOORBELL APP shall not be liable for any loss or damage, howsoever arising, suffered by you as a result of the disclosure of such information to the third party. This is because we do not regulate or control how that third party uses your personal information. You should always ensure that you read the privacy policy of any third party.

SECURITY

We and our third party service providers

use reasonable organizational, technical and administrative measures to protect PII under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. Please do not send us sensitive information through email. If you have reason to believe that your interaction with us is not secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us in accordance with the “Contacting Us” section below. (Note that if you choose to notify us via physical mail, this will delay the time it takes for us to respond to the problem.)

UNSUBSCRIBE

If you do not wish to receive marketing-related emails from us, you may unsubscribe from receiving them by clicking on the “unsubscribe” link at the bottom of any of those emails.

CHANGING PII. You may review, correct and/or update certain elements of your PII by adjusting your preferences in the “My Profile” section of our site. We and our third party service providers are not responsible for altering PII from the databases and/or other records of third parties with whom we and our third party service providers have shared your PII.

RETENTION PERIOD

 

We and our third party service providers will retain PII for the period reasonably necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

THE DOORBELL APP UNDERTAKES TO NEVER SELL OR MAKE YOUR PERSONAL DATA AVAILABLE TO ANY THIRD PARTY OTHER THAN AS PROVIDED FOR IN THIS POLICY UNAUTHORISED AND UNLAWFUL ACTIVITY

 

While we will do all things reasonably necessary to protect your rights of privacy, we cannot guarantee or accept any liability whatsoever for unauthorised or unlawful disclosures of your personal information, whilst in our possession, made by third parties who are not subject to our control, unless such disclose is a result of our gross negligence.

DISCLAIMER

 

If you choose to access the Sites, you do so at your own risk, and are responsible for complying with all local laws, rules and regulations. We may limit the availability of the Sites, in whole or in part, to any person, geographic area and/or jurisdiction we choose, at any time and in our sole discretion. By using the Sites and submitting any PII, you consent to the transfer of PII to other countries, such as the United States, which may provide a different level of data security than your country of residence provides.

General Terms to doorbell delivery service with the Client

These General Terms shall apply to all relations between doorbell and the User related to the use of the doorbell Platform (as defined below) as well as certain aspects of Sales Agreements and Delivery Agreements concluded through the doorbell Platform (as defined below). By signing up in the doorbell Platform, the User agrees to the application and content of these General Terms and is informed about the processing of his/her personal data disclosed during registration and use of the doorbell Platform on the conditions set out below

1. DEFINITIONS

Balance means the User’s account balance on the doorbell Platform.

doorbell Platform means the delivery platform operated by doorbell as the information society service which functions as the Marketplace that (i) enables Partners to market Goods with delivery option and enter into Sales Agreements for the sale of Goods to Clients, (ii) enables the Users to place Orders of Goods with the Partner, enter into Sales Agreements as Clients and arrange the delivery of the Goods by the Courier and (iii) enables the Courier to offer delivery services to the Clients for the delivery of the Goods and enter into Delivery Agreements with Clients.

Client means any User of the doorbell Platform that has placed an Order and enters into a Sales Agreement with the Partner and a Delivery Agreement with the Courier (if applicable).

Courier means any natural person, sole entrepreneur or legal entity and where relevant, its employees and/or contractors, who have been registered in the doorbell Platform as a provider of the delivery service to Clients with respect to Goods ordered through the doorbell Platform.

Courier Fee means the fee for the delivery services related to an Order, that the Client pays to the Courier under the Delivery Agreement. The Courier Fee is calculated in accordance with the principles set out in Section 6.

Delivery Agreement means the agreement between the Client and the Courier for the delivery of the Goods ordered by the Client concluded through the doorbell Platform.

Drop-Off Location means the address indicated in the Order, where the Client wishes to receive the ordered Goods.

General Terms means these terms and conditions applicable to the relationship between doorbell and the Client in relation to the use of the doorbell Platform by the Client.

Marketplace means the virtual marketplace created through the doorbell Platform and operated by doorbell that enables the participating Partners to market their Goods to Users so that the Users can order the Goods and enter into the Sales Agreement with the Partner as Clients for purchasing the Goods and utilise the on-demand delivery services offered at the Marketplace by the Couriers.

Goods means any goods that the Partner offers for sale through the doorbell Platform.

Goods Price means the net price (together with applicable value added, sales or other taxes where applicable) that the Client has to pay to the Partner for the ordered Goods.

Minimum Order Value means the amount determined by the doorbell Platform which indicates the minimum Goods Price for which an Order can be placed through the doorbell Platform.

Small Order Fee means the fee payable by Client to Courier in accordance with Section 3.3 in order to compensate the difference between the Minimum Order Value and the Goods Price of a particular Order.

Order means the order of Goods that the Client has placed with the Partner.

Order Price means the price that the User has to pay for the purchase(d) Goods and delivery (if applicable) of the Order.

Partner means the operator of any restaurant or store that doorbell has concluded an agreement with and where relevant, each and every establishment through which the operator conducts its business.

Sales Agreement means the agreement between the Client and the Partner for the sale of Goods in accordance with the Order.

User means any person that has registered a user account on the doorbell Platform and uses the services of the doorbell Platform through that user account.

    2    LEGAL FRAMEWORK 

    •         2.1.  The doorbell Platform enables the Client to order Goods from Partners and arrange the
      delivery of the Orders to the Drop-Off Location. 

    •         2.2.  For the sale of Goods through the doorbell Platform a Sales Agreement is concluded directly between the Client and the Partner. For the delivery of the Order, the Client enters into a Delivery Agreement directly with the Courier. In case the Partner wants to offer its own delivery services to the Client for the delivery of the Goods, the Client enters into a Delivery Agreement directly with the Partner and the conditions applicable to Couriers under these General Terms apply to the Partner in respect of the Delivery Agreement. The Sales Agreement and the Delivery Agreement are deemed to be concluded from the moment that the Order is confirmed on the doorbell Platform. A request for the delivery of an Order is sent to a Courier who is the closest to the Partner preparing the Order and who would deliver the Order to the Client the fastest. 

    •         2.3.  By operating the doorbell Platform and the Marketplace, doorbell acts only as a provider of the information society service and is neither a party to the Sales Agreement or the Delivery Agreement. doorbell is not the manufacturer or seller of the Goods or provider of the delivery services and is not liable in any way for the performance of the Sales Agreement or the Delivery Agreement. 

    •         2.4.  By operating the doorbell Platform, doorbell acts as the agent for the Partners in relation to mediation of Sales Agreements between the Partners and the Clients. doorbell also acts as the agent for the Couriers in relation to mediation of Delivery Agreements between the Couriers and the Clients. As the agent doorbell has been authorised by each Partner and each Courier to receive payments from the Clients on behalf of the respective principal and allocate the received funds between the Partners and the Couriers. 

  1. ORDERING GOODS THROUGH doorbell PLATFORM 

3.1. The Client can select and order Goods through the doorbell Platform. In the event that the Partner cannot provide the Goods as requested in the Order, the Partner will not confirm the Order in the doorbell Platform. The Partner may contact the Client in order to agree on changes to the Order, so that the initial Goods Price would remain the same. If no agreement is reached or if the Client would have to pay more or less for the replacement Goods than the ordered Goods, the Order will be cancelled and the Client will not be charged for the Order or (where applicable) the Order Price will be returned to the Client in full.

  •         3.2.  The Client has a right to receive Goods which comply with their description set out in the doorbell Platform and any specific requirements (if agreed upon). In case the Goods contain food and in case of doubt regarding any allergies that the Client may have to any such Goods, the Client is to contact the Partner for further information. 

  •         3.3.  If the Minimum Order Value applies and the Goods Price related to an Order is below that Minimum Order Value the Client can place an Order and it will be confirmed by the doorbell Platform on the condition that the Client compensates the difference between the Minimum Order Value and the Goods Price for that Order in the form of the Small Order Fee payable to the Courier. 

  •         3.4.  During the creation of a User account enabling access to the doorbell Platform, the User’s mobile number is linked to the respective doorbell User account and added to doorbell’s database. If the User is no longer using the mobile number, he/she must notify doorbell within 7 days so that the User’s account data could be anonymized. If the User does not notify doorbell about any change to his/her number, the mobile operator might pass the same mobile number to a next person and when using the doorbell Platform, this new person can see the User’s data. 

  •         3.5.  The Client must comply with applicable laws, including the requirements applicable upon purchase of alcohol, tobacco, energy drinks or any other products requiring age verification. In case the Client wants to order products requiring age verification, he/she must confirm and/or prove his/her age as part of the ordering process. Further, the Courier delivering the Order and/or the Partner in case of self pick-up by the Client may refuse to hand over the products requiring age verification, if the Client does not present a valid photo identification proving that he/she is old enough to legally purchase the products. 

4. ORDERING DELIVERY THROUGH doorbell PLATFORM

  •         4.1.  Upon placement of the Order the Client has to arrange the delivery service by the Courier through the doorbell Platform in order to procure delivery of the Goods to the requested Drop-Off Location or if available choose a self pick-up option. The Client will enter into the Delivery Agreement with the Courier through the doorbell Platform. 

  •         4.2.  The Courier will deliver the Order to the Drop-Off Location indicated by the Client through the doorbell Platform. The Client and the Courier may agree on a different Drop-Off Location, provided that the new address is close to the original Drop-Off Location (not more than a few blocks away). 

  •         4.3.  The Client must be present at the Drop-Off Location at least at the estimated time of delivery of the Order indicated on the doorbell Platform. The Client must be available to receive calls at the phone number submitted through the doorbell Platform from the moment of submitting the Order on the doorbell Platform until receiving the Order from the Courier. 

  •         4.4.  doorbell, on behalf of the Courier, may cancel the delivery and charge the Client or reduce the Client’s Balance for the full price of the Order in the following cases: 

  •         4.4.1.  the Client is not available at the Drop-Off Location within 10 minutes of the arrival of the Courier thereto; 

  •         4.4.2.  the phone number provided by the Client cannot be reached by the Courier within 10 minutes of the Courier's arrival at the Drop-Off Location; or 

  •         4.4.3.  the Client and the Courier fail to agree on a new Drop-Off Location according to Section 4.2 above. 

4.5. Any doorbell through the doorbell Platform are only estimated times. There is no guarantee that the Goods will be delivered at the estimated time. Delivery times of the Orders may also be affected by factors such as traffic jams, rush hours and weather conditions.

  •         4.6.  In case the Client chooses self pick-up of an Order, the Client must arrive at Partner’s establishment following indicative Order collection time as provided on the doorbell Platform, in order to collect an Order. 

  •         4.7.  Partners’ rating on the doorbell Platform is based on the reviews left by the Clients after the Order has been delivered to the Client or, if applicable, after the Order has been picked up by the Client. The Client is entitled to leave a review to a Partner by evaluating the Order on the scale from 1 (poor) to 5 (outstanding). It is not possible for the Client to rate a Partner or leave a review unless the Client has placed an Order with the Partner on the doorbell Platform. 

  1. COMPLAINTS 

    •         5.1.  If the Client has any complaints regarding the ordered Goods or the delivery of the Order, the Client is encouraged to inform doorbell thereof through the doorbell Platform as soon as possible, but no later than within one month of the delivery of the specific Order. doorbell may request a photograph of the Goods or other evidence or explanation of the circumstances related to the complaint. 

    •         5.2.  Although doorbell is neither the manufacturer or seller of Goods, nor provider of the delivery services and is not responsible for respective goods or services, doorbell will try to facilitate an amicable solution and may provide a refund or Balance in respect of the affected Goods or the delivery, if doorbell has reasonable cause to believe that the complaint is justified. 

    •         5.3.  The Client may also submit complaints to the Partner or the Courier directly. 

    •         5.4.  The Client can contact doorbell’s customer support via chat function on the doorbell Platform where the Client can review the open chats and the communication history thereof, including its date and time, for 6 months as of creating the chat. 

  2. PAYMENTS AND INVOICING 

6.1. The Client has to pay the Goods Price to the Partner in the amount indicated on the doorbell Platform. Goods Prices in the doorbell Platform may differ from the Goods Prices

delivery time or other time estimate communicated to the Client by the Courier or

in the Partner’s establishment. The Goods Prices on the doorbell Platform may be changed from time to time before making an Order.

  •         6.2.  The Client has to pay the Courier Fee to the Courier in the amount calculated by the doorbell Platform. The Courier Fee will be calculated taking into account the time of delivery, length of delivery route, means of delivery and other criteria. The applicable Courier Fee will be indicated to the Client prior to confirmation of the Order. The details of calculation of the Courier Fee may be adjusted from time to time by the doorbell Platform taking into account the market situation, supply and availability of the Couriers on the Marketplace, and other factors relating to the service. 

  •         6.3.  doorbell has the right to establish a Minimum Order Value in accordance with Section 3.3. In such case the Client will reimburse the difference of the Order Price and the Minimum Order Value to the Courier in the form of a Small Order Fee. 

  •         6.4.  doorbell, acting as an agent of the Partner and the Courier, shall prepare and issue to the Client informational receipts for the Goods Price on behalf of the Partner and the Courier Fee and (where applicable) the Small Order Fee on behalf of the Courier, and accept the Client’s payment for the cash register’s receipts on behalf of the Partner and the Courier. doorbell is authorized to collect the Goods Price, the Courier Fee and (where applicable) the Small Order Fee from the Client on behalf of the Partner and the Courier respectively and distribute the sums accordingly to the respective principal. 

  •         6.5.  All payments are processed from Client’s payment card or other payment methods activated by the Client on the doorbell Platform, except for cash payments. Payments are processed through a third-party payment processor. Upon confirming the Order the Client authorises the payment with its payment card or using other eligible payment method in the amount of the Order Price, and the respective amount will be reserved on the payment card or through other means of payment. The payment related to the Order will be performed and charged from the Client’s payment card or using other payment methods within 72h from confirmation of the Order. 

  •         6.6.  The payment obligations of the Client arising from the Sales Agreement and the Delivery Agreement (if applicable) are deemed to be fulfilled respectively towards the Partner and the Courier (if applicable) when payment has been performed to doorbell and charged from the Client’s credit card or other eligible payment methods (e.g. doorbell Business) or, as the case may be, when the Client has paid the Order Price in full to the Courier in cash upon the delivery of the Order or the Client has paid the Order Price in full to the Partner directly in case of self pick-up by the Client. If the Order Price cannot be reserved on the Client’s credit card, the Order will not be forwarded to the Partner, except for cash payments to the Courier upon the delivery of the Order or direct payment to the Partner in case of self pick-up by the Client. 

  •         6.7.  doorbell may facilitate an option to the Client that allows the Client to pay for the Order in cash to the Courier upon the delivery of the Order. In such a case, the Client shall pay the Order Price to the Courier in cash upon delivery of the Order to the requested Drop-Off Location. doorbell may, at its own discretion, limit cash payments for a specific Client. 

  •         6.8.  In case of cash payment, the Courier shall insert the sum of cash received from the Client to the doorbell Platform. In case the sum does not correspond to the payment obligations of the Client arising from the Sales Agreement and the Delivery Agreement, then the Balance shall automatically: 

    •         6.8.1.  decrease by the amount paid less for the Order or by the full Order Price (e.g. in case the Client is not present at the Drop-Off Location, as per Section 4.4, the Client refuses to pay, etc); 

    •         6.8.2.  increase by the amount paid more for the Order. 

  •         6.9.  The Balance shall apply automatically upon placement of an Order. The Balance cannot be exchanged for cash. 

  •         6.10.  doorbell, at its sole discretion, can make promotional offers and discounts regarding the Goods Price or the Courier Fee. 

  •         6.11.  By agreeing to these General Terms the Client expressly consents to the receipt of electronic invoices. Electronic invoices are issued and received in any electronic format, including via email with a document attached in PDF form. 

CANCELLATION AND SUSPENSION OF USE

  •         7.1.  The Client may not withdraw from or cancel an Order. 

  •         7.2.  doorbell is entitled to remove a Client from the doorbell Platform with immediate effect and/or refuse or cancel any Orders, if the Client causes any abuse or harm to the doorbell Platform, if doorbell has reasonable belief of fraudulent acts by the Client when using the doorbell Platform, or if the Client otherwise fails to comply with his/her obligations under these General Terms (e.g. by not being present at the Drop-Off Location on several occasions, as per Section 4.4). Suspension from the doorbell Platform means also suspension from other doorbell platforms (e.g. ride-hailing platform). 

  •         7.3.  The Client shall not use the doorbell Platform for money laundering purposes as well as any other criminal activity. If the Client violates this Section 7.3, doorbell will permanently suspend the Client from using the doorbell Platform as well as will notify relevant law enforcement agencies. 

LICENCING, INTELLECTUAL PROPERTY RIGHTS AND DATA PROCESSING

  •         8.1.  By registering on the doorbell Platform, doorbell grants the User a revocable, non-exclusive, non-transferable, non-sublicensable license to use the doorbell Platform for the purpose of ordering Goods and arranging the delivery of the Orders. 

  •         8.2.  All intellectual property rights regarding the software, documentation or information used or developed by or on behalf of doorbell during the provision of the information society services under these General Terms (incl. the doorbell Platform and any material uploaded therein) belong to doorbell (or, sometimes, to a limited extent, the Partner). The User shall not copy, modify, adapt, reverse-engineer, decompile or otherwise discover the source code of the doorbell Platform or any other software used by doorbell or extract or use any data on the doorbell Platform for commercial purposes or any other purpose 

than ordering Goods. The User shall use the doorbell Platform solely for his/her personal, non-commercial purposes.

  •         8.3.  The principles for processing the Users’ and Clients’ personal data are set out in the Privacy Policy available on the doorbell Platform. 

  •         8.4.  doorbell is not providing any warranties, guarantees or representations regarding the quality of the doorbell Platform, including regarding the absence of apparent or hidden defects, fitness for ordinary or particular (special) purpose, and doorbell is not required to satisfy the User’s claims regarding the quality of the doorbell Platform. 

LIABILITY

  •         9.1.  The Partner is solely liable for any defects in the quality and quantity of the ordered Goods or other shortcomings in the performance of the Sales Agreement and doorbell does not assume any liability thereof (including liability for any allergic reactions to food or any other health issues). 

  •         9.2.  The Couriers are solely responsible for the performance of the Delivery Agreement and doorbell does not assume any liability thereof. 

  •         9.3.  If a User suspects that his/her credit card associated with their doorbell Platform has been stolen and/or is being fraudulently used by a third party, the User has to inform doorbell thereof immediately. Until receiving such notification, doorbell will not be liable for any fraudulent use of the User’s credit card by third parties on the User’s account. 

  •         9.4.  The doorbell Platform is provided to the User strictly on an "as is" basis. doorbell will not be liable for any interruptions, connection errors, unavailability of, or faults in the doorbell Platform, however, doorbell does not limit the Client’s right to claim for damages or use any other legal remedies provided by law upon non-compliance of the services of the doorbell Platform with these General Terms. Furthermore, doorbell upon its sole discretion may introduce new and/or discontinue existing functions to the doorbell Platform, Clients will be notified by doorbell of such discontinuations accordingly. 

MISCELLANEOUS

  •         10.1.  The Client has a statutory right to withdraw from the Sales Agreement in accordance with and in respect of Goods listed in Directive 2011/83/EU within 14 days of the order date without giving any reasons. If the Client wants to withdraw from such Goods, the Client may either (i) use the model withdrawal form provided in Schedule 1 or (ii) make any other unequivocal statement setting out the decision to withdraw from such Goods by contacting doorbell. 

  •         10.2.  doorbell reserves the right to make changes to the General Terms at any time, by uploading the revised General Terms onto the doorbell Platform and notifying all Users thereof through the email address provided by the Client during signup.

  •         10.3.  doorbell may change or remove different parts of the doorbell Platform or change the doorbell Platform, its features and the selection of Partners participating in the doorbell Platform in part or in whole at any time without prior notice. 

  •         10.4.  The Client can only access the doorbell Platform with an internet connection. There are no specific technical requirements for the internet connection, however, the quality of the services of the doorbell Platform may be affected by the internet speed. The doorbell Platform is available on Android and Apple devices in accordance with the latest software updates. 

  •         10.5.  The doorbell Platform is available in multiple languages which can be changed in the Client’s profile. 

  •         10.6.  doorbell may track the location of the Client’s device via the doorbell Platform. There may be restrictions for the provision of services of the doorbell Platform based on the location of the Client’s device. These restrictions are apparent via the interface of the doorbell Platform (e.g., the available Partners based on the location). doorbell does not provide the services in all jurisdictions. As the availability of doorbell’s services may change from time to time, there is no concrete list of the jurisdictions. 

  •         10.7.  doorbell provides the services which are designed, delivered, and support compliance with industry standards and best practices, such as ISO 27001/27002, whenever feasible and not in conflict with other agreed requirements. 

  •         10.11.  Where versions of these General Terms exist in any other language, the English language version shall prevail.
